Affiliate & Partner Program Terms and Conditions

By registering for, participating in, or promoting products through the ZKCE Affiliate & Partner Program (the “Program”), you (“Partner”, “you”, or “your”) agree to be bound by these Terms and Conditions (“Terms”). ZKCE (“we”, “us”, or “our”) reserves the right to update these Terms with 30 days’ prior written notice via email or dashboard announcement.
1. Eligibility and Entry Pathways
- You must be at least 18 years old and capable of entering into legally binding contracts.
- You must have a verifiable audience, follower base, or sales channel on platforms such as TikTok, YouTube, Instagram, X (Twitter), Facebook, blogs, or other media (recommended but not required for basic participation).
- Referral Entry Pathway (Primary Entry Method): All participants begin by purchasing a product and receiving a unique referral link through our “Get Product for Free” offer. Upon successfully referring 3 valid orders (resulting in your full product price refund), you will automatically be enrolled as a full Affiliate Partner. Starting from your 4th direct referred order onward, you will earn commissions on your own direct referrals according to this Program.
- Direct Entry (Optional): We may approve direct applications at our discretion, but the referral pathway is the standard and encouraged method.
2. Enrollment
- Approval into the Program is at our sole discretion.
- For Referral Entry participants: Enrollment as an Affiliate Partner is automatic upon approval of your refund after 3 valid referrals. You will receive confirmation email and access to your personal affiliate dashboard.
- We may reject or terminate participation for any reason, including suspected fraud or violation of these Terms.
3. Commission Structure (Single-Tier Only)
All commissions and bonuses are calculated solely based on sales directly referred by you through your unique affiliate/referral link. Valid sales are non-refunded, non-cancelled orders completed by end customers.
- Tiered Commission Rates (applied monthly based on your personal direct units sold):
- 1–1,000 units: 15%
- 1,001+ units: 20%
- Annual Performance Bonus Partners who personally generate 10,000 or more valid units sold through their direct referrals in a single calendar year (January 1 – December 31) will receive a one-time bonus of $20,000 USD, paid within 60 days of year-end verification.
- Important Single-Tier Rules:
- Sales generated by customers you refer (or by anyone they subsequently refer) do not count toward your sales volume, commissions, or bonus eligibility.
- There are no downline commissions, multi-level rewards, override commissions, or recruitment-based bonuses. All compensation is tied exclusively to product sales you personally and directly refer to end users.
- For Referral Entry Partners: Commissions begin only from your 4th direct referred order onward. The first 3 referrals qualify solely for your initial product refund and do not earn commissions.
4. “Get Product for Free” Referral Offer (Mandatory Entry Pathway)
- Every purchaser automatically receives a unique referral link after order confirmation.
- If 3 valid orders (units purchased, delivered, and not refunded/cancelled) are completed through your direct referral link, you qualify for a full refund of your original product price (excluding shipping, taxes, and fees).
- A 30-day waiting period begins after the 3rd valid order is marked complete. Refund is processed automatically or upon request after this period.
- If any of the 3 orders is refunded or cancelled, the count resets. You may continue referring to reach 3 new valid orders.
- Independence of Referrals: Customers you refer receive their own independent referral links. Their referrals and sales are tracked separately and do not contribute to your commissions, volume, or rewards in any way. Each referred customer operates as an independent participant.
- Upon refund approval, you automatically become a full Affiliate Partner under Section 3.
5. Payment Terms
- Commissions are calculated monthly and paid within 15 days of the following month, after order verification.
- Minimum payout threshold: $50 USD. Balances below threshold roll over to the next month.
- Payments issued via PayPal, bank transfer, or other mutually agreed method.
- You are solely responsible for any payment processing fees, taxes, and reporting commissions/refunds as income per applicable tax laws (e.g., IRS rules).
6. Tracking & Reporting
- You will receive a personal affiliate dashboard to monitor your direct referrals, sales, commissions, and progress.
- We use cookies and unique tracking links with a 30-day cookie window. Sales must occur within this window to qualify as your direct referral.
7. Promotional Guidelines & FTC Compliance
- You may promote our products freely on your channels, provided you comply with all applicable laws, platform terms of service, and FTC guidelines.
- Mandatory Disclosure Requirement: You MUST clearly and conspicuously disclose your material connection in every promotion containing your referral or affiliate link. Recommended examples:
- “This is my referral/affiliate link – if 3 people buy through it, I get my purchase refunded. After that, I earn commissions on my direct referrals.”
- “I earn commissions from qualifying purchases made through my links (#ad).”
- Use #ad, #sponsored, or platform built-in disclosure tools as appropriate.
- Prohibited Activities: False or misleading claims, deceptive marketing, spam, paid ads bidding on our brand terms, cookie stuffing, or any practice that violates platform policies.
- Single-Tier Emphasis: This is a strictly single-tier program. All marketing materials must accurately reflect that earnings come only from your own direct referrals and sales. No multi-level or downline compensation is offered or permitted.
- Income Disclosure: Actual earnings vary significantly. Most participants earn little or no money after expenses (including the initial product purchase). Typical earnings data is available upon request.
8. Intellectual Property
- We grant you a limited, revocable, non-exclusive license to use provided brand assets (logos, images, videos, banners) solely for legitimate promotion under these Terms.
- You may not modify assets, imply unauthorized endorsement, or use them after termination.
9. Term & Termination
- These Terms remain in effect until terminated by either party.
- We reserve the right to suspend or terminate your account immediately for fraud, material violations, or at our sole discretion.
- Valid earned commissions prior to termination will be paid according to the normal schedule.
- Upon termination, you must immediately cease all promotion and remove all links and assets.
10. Modifications
- We may modify these Terms, commission rates, bonus thresholds, or Program structure with 30 days’ prior written notice via email or dashboard announcement.
- Continued participation after the notice period constitutes acceptance of the changes.
11. Limitation of Liability & Indemnification
- We are not responsible for technical issues, lost referrals, third-party platform changes, or indirect damages.
- Our maximum liability shall not exceed the total commissions paid to you in the prior 12 months.
- You agree to indemnify us against claims arising from your promotional activities or violations of these Terms.
12. Governing Law
- These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles.
